A Texas woman, Jessica Barber Gutierrez was driving erratically when she pulled into a Valero (Gas Station) parking lot. She was approached by the police who noticed that her breath smelled of alcohol and she appeared to have been drinking. When questioned, Gutierrez admitted to drinking beer, taking Prozac and Xanax.
As the police continued to question her, they noticed that there was something moving amongst what looked like trash in the backseat. Upon inspection they discovered that there was an 8 month old child buried under clothes, boxes, plants and a skateboard.
Gutierrez was arrested and the child taken to Child Protective Services. There were no signs that the baby was being properly cared for. After inspection of the entire vehicle the police found no infant care items such as baby bottles, clothes or diapers.
Gutierrez told the police that she had a 12 year old who was home with her 20 year old roommate whose name she could not remember at the time. She revealed that she had also been smoking Potpourri and didn’t know that was illegal.
This was her second DWI while driving with a child under 15. She is being held in the Montgomery County Jail being on $25,000 bond.
